1. About these terms

These terms apply to your use of whitsundays.tours (the site). The site is run by Whitsunday Islands Tours, a locally owned business based in Airlie Beach, Queensland, Australia. In these terms, "we", "us" and "our" mean Whitsunday Islands Tours.

By using the site you agree to these terms. If you do not agree with them, please do not use the site.

2. What this site is

The site is a directory of tours, activities and accommodation in the Whitsundays and Airlie Beach. It gathers information about each product in one place so you can compare them and go straight to the booking.

We are not a tour operator. We do not run the tours, own the vessels or aircraft, take payments or issue tickets.

Booking buttons on the site take you to the tour operator's own booking system or to a booking partner, such as FareHarbor, Rezdy, Viator or Book Me. When you book:

• your booking is an agreement between you and the operator or booking partner, not with us
• their terms and conditions, cancellation policy and refund policy apply
• your payment is processed by them, and your confirmation comes from them

For changes, cancellations, refunds or questions about an existing booking, contact the operator or booking partner named on your confirmation.

3. Affiliate links and how the site earns money

Some booking links on the site are affiliate links. If you book after clicking one, we may be paid a commission by the booking partner or operator. This does not change the price you pay.

Some operators listed on the site are also clients of Ripple Effect Online, the agency that builds and manages this site.

4. Prices, availability and tour information

We work to keep prices, inclusions, departure times, age limits and other details accurate, and pages are updated when operators advise of changes. Operators can change any of these without notice, so:

• the price, inclusions and conditions shown at checkout on the booking system are the ones that apply to your booking
• "From" prices are the lowest standard price known at the time the page was last updated
• sale prices and promo codes are set by the operators and can change or end at any time
• availability shown in a booking system is controlled by the operator or booking partner
• itineraries, maps, photos and videos are a guide to what a tour is normally like, not a guarantee of what happens on a particular day

Tours in the Whitsundays depend on weather, wind, tides and safety conditions. Operators may change an itinerary, swap a location or cancel a departure. How that is handled is covered by the operator's own terms.

5. Your responsibilities when booking a tour

Before you book, please:

• read the operator's terms and conditions, including the cancellation and refund policy
• check the tour suits everyone in your group, including age limits, fitness level, swimming ability and any medical conditions
• tell the operator about dietary needs, mobility needs or health conditions when you book
• consider travel insurance that covers cancellations and medical costs

Booking systems generally require the person making the booking to be 18 or over.

6. Reviews and ratings

Google ratings and reviews shown on tour pages are supplied by Google from the operator's Google business listing. They are the opinions of the people who wrote them. We do not write, edit or select them, and we cannot confirm they are accurate.

7. Emails from us

If you contact us, we will reply to you by email. If you sign up to receive something from the site, such as a free guide or deals by email, you agree to receive marketing emails from us. Every marketing email includes an unsubscribe link, and you can also ask us to remove you at any time.

8. Copyright and intellectual property

The text, design, layout and original photos on the site are owned by Whitsunday Islands Tours or used under licence. Operator names, logos, photos and videos belong to their owners and are used with permission.

You are welcome to view the site, link to it, share pages and print pages for planning your own trip. Without our written permission you must not:

• copy or republish content from the site on another website or in other material
• use automated tools to scrape, harvest or bulk download content, prices or images
• use the site's content to build or populate another directory, booking site or dataset
• use any trade mark or logo shown on the site

Reporting a copyright concern

If you believe a photo, video or text on the site uses your work without permission, email info@whitsundays.tours with the address (URL) of the page, a description of the work, and proof that you own it or are authorised to act for the owner. We will reply within 5 business days and remove or replace material that should not be here. We may pass your notice to the operator who supplied the material so they can respond.

9. Content you send us

If you post a comment, or send us a review, photo or other material to publish, you keep ownership of it. You give us a non-exclusive, royalty-free licence to publish it on the site and on our social media pages, and to edit it for length and clarity. You confirm that it is yours to share and that it does not infringe anyone else's rights.

Do not submit anything that is unlawful, defamatory, abusive, misleading, spam, or that advertises another business. We can remove any submitted content at any time.

10. Acceptable use

You must not:

• try to get around the site's security, or access areas, accounts or data that are not meant for you
• probe, scan or test the site for vulnerabilities without our written permission
• upload or send viruses or other harmful code
• overload or disrupt the site, including by flooding it with requests
• use the site to send unsolicited messages or advertising
• pretend to be another person or business

11. Links to other websites

The site links to websites we do not control, including operator websites, booking systems, Google Maps and YouTube. Those sites have their own terms and privacy policies. We are not responsible for their content or for how they operate.

12. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or changes any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

The services you buy through a booking link are supplied by the operator or booking partner, and consumer guarantees for those services apply to them.

13. Limits on our liability

The site is provided for general information. We take care with it, but we do not promise that it will always be available, free of errors or completely up to date.

To the extent the law allows, we are not liable for:

• the supply, quality, safety or conduct of any tour, activity, accommodation or transfer, which are the responsibility of the operator
• cancellations, delays, itinerary changes, weather or anything else that affects your booking
• any difference between information on the site and the information shown by an operator or booking system
• the content or performance of other websites and booking systems
• indirect or consequential loss, such as lost travel costs, lost enjoyment or lost profits

Where our liability cannot be excluded but can be limited, it is limited to supplying the service again or paying the cost of having it supplied again.

14. If you misuse the site

If you break these terms and that causes us loss, for example by scraping the site or posting content that infringes someone's rights, you agree to cover the reasonable costs and losses that result directly from what you did. This does not apply to the extent that we caused or contributed to the loss.

15. Changes to the site and these terms

We can add, change or remove pages, listings and features at any time. We can also update these terms. The updated version will be published on this page with a new "last updated" date, and it applies from the date it is published. It does not change anything that happened before that date.

16. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.

The site is run from Australia. If you use it from another country, you are responsible for following your local laws.

17. General

If any part of these terms is found to be invalid or unenforceable, that part is removed and the rest continues to apply. If we do not enforce a term straight away, that does not mean we have given up the right to enforce it later.
